Terms of Service

The owner of the Online Store located at www.mysticforest.eu is FOREST-B NADEZHDA VUCHEVA, registered at Niemcewicza 26/44, 02-306, Warsaw, entered into the Central Register and Information on Economic Activity, NIP: 7011057214, REGON: 520287105 (hereinafter referred to as “Mystic Forest” or the “Seller”).

Glossary of terms used in these Terms:

Entrepreneur – a legal entity conducting business activity on its own behalf, including Mystic Forest.
Buyer – any entity placing an Order in the Online Store (a Consumer or a person who is not a Consumer).
Consumer – a natural person performing a legal act (including entering into a sales contract) with an entrepreneur, not directly related to their business or professional activity (hereinafter also referred to as the “Client”).
Complaint – a procedure applied in the event of a defect in the sold goods.
Warranty – a legal procedure for pursuing liability from the entrepreneur who sold the goods to a Consumer when a physical or legal defect appears.
Goods – items available for sale in the Online Store.
Material defect – a basis allowing the Consumer to exercise specific rights under the warranty.
Information document – a document attached to the Goods informing the Consumer about proper use of the product.
Online Store – the website belonging to Mystic Forest through which the Buyer places an order.
Order – a declaration of intent made by the Buyer aimed at concluding a distance sales contract for Goods via the Online Store, specifying at least the type and quantity of Goods.

GENERAL INFORMATION

  1. These Terms define the rules for concluding and performing sales contracts for Goods available on the Online Store website.

  2. To place Orders via the Online Store, it is necessary to have devices enabling access to the Internet, an email account, and a web browser.

  3. The main business activity of Mystic Forest is the sale of functional ceramics, ceramic jewelry, and related accessories.

  4. The content of the Online Store does not constitute an offer within the meaning of civil law; therefore, placing an order does not mean the immediate conclusion of a contract.

  5. Orders placed for products presented by Mystic Forest constitute only an invitation to submit purchase offers. The sales contract is concluded once Mystic Forest confirms the order via an email sent to the Client. Until such confirmation is received, the Client is entitled to cancel the order.

  6. Mystic Forest makes every effort to ensure that photos, descriptions, and technical data of the Goods are as accurate as possible.

  7. The Goods are manufactured by Mystic Forest.

  8. The Consumer may contact the Seller via email at mystic.forest.mugs@gmail.com

  9. In matters not regulated by these Terms, the generally applicable laws apply, including the Civil Code and the Consumer Rights Act.

  10. These Terms do not exclude or limit any rights of a Consumer granted by mandatory provisions of law. In the event of any conflict between these Terms and mandatory legal provisions granting rights to Consumers, those legal provisions shall prevail.

SALE OF GOODS

  1. All Goods prices listed in the Online Store are gross prices expressed in Polish zloty (PLN) and include all taxes and charges, including VAT.

  2. In addition to the price of the Goods, the Consumer also covers the cost of delivery to the address indicated in the order.

  3. The delivery cost is added to the order amount.

  4. The delivery cost depends on the delivery method chosen by the Consumer.

  5. Mystic Forest accepts the following payment methods:

  7. The payment deadline for bank transfer payments or payments made via an electronic payment system is immediately after placing the order.

ORDER FULFILLMENT

  1. Mystic Forest accepts orders electronically via the Online Store 24/7, seven days a week.

  2. To place an Order through the Online Store, add the selected Goods to the cart and follow the instructions displayed on the website.

  3. The Seller is obliged to deliver Goods purchased by the Consumer without physical or legal defects.

  4. The contract is concluded when the Seller accepts the order, which must be communicated to the Client within 48 hours of placing the order.

  5. Fulfillment of an order paid by bank transfer or electronic payment takes place after the contract is concluded and the Consumer’s payment is credited to the Seller's account, but no later than 4 business days after the payment is credited.

  6. If, for objective and independent reasons, the ordered Goods are unavailable in the warehouse, the Client will be immediately informed and may change the Goods, agree to a longer processing time, or cancel the order, in which case all payments will be refunded.

  7. When placing an order, the Buyer should provide a contact phone number and email address necessary for confirming the order.

  8. Providing incorrect data may prevent order fulfillment; in particular, an incorrect delivery address may delay delivery.

SHIPPING OF GOODS

  1. Goods purchased by the Consumer are delivered by courier within Poland and EU countries to the delivery address provided in the order. Delivery through InPost parcel lockers is also available.

  2. Delivery to the Consumer is paid, subject to the “Sale of Goods” section.

  3. If the Buyer finds damage to the package, Mystic Forest recommends drawing up a damage report in the presence of the courier, containing the recipient’s and courier’s details and a brief description of the condition of the Goods, and informing the Seller immediately.
